Just Smarter Eval (the "Service", sometimes referred to in
these terms as "Just Smarter" for brevity) is operated by Xalerate AB,

support@justsmarter.ai. The Service
includes both the batch evaluation runner at /eval and the
multi-model chat interface at /app, as well as all supporting
APIs, dashboards, datasheets, and documentation accessible through the
justsmarter.ai domain. By creating an account or using the Service
in any way, you agree to these terms.
You must provide accurate information when creating an account and you are responsible for maintaining the security of your credentials. One person per account. You agree not to share credentials with others or create accounts to evade suspension.
You must be at least 16 years old to use Just Smarter. We enforce this at registration through a required birth-year field; accounts that do not meet the age minimum are rejected. The 16-year threshold is the default EU age of consent for data processing under GDPR Article 8(1), which we apply uniformly across all jurisdictions. If you are under 18 you additionally confirm that you have permission from a parent or legal guardian to create an account and make purchases.
New accounts must verify their email address before credit-consuming features (chat, councils, search, eval runs) become available. Unverified accounts can still access settings, legal documents, and billing.

We may suspend or terminate accounts that violate this section and may refuse refunds for credits consumed on violating requests.
Just Smarter uses a credit-based billing model. One credit is roughly equivalent to one word processed through a standard AI model; premium models (e.g. Claude Opus, GPT-o3) consume credits at a higher rate, mini models at a lower rate. Current multipliers are listed in the app under "How Credits Work".
4.1 Plans. Just Smarter offers five plans:
4.2 Credit lifecycle. Monthly credits reset at the start of each billing cycle and do not roll over. Purchased top-up credit packs roll over month to month and expire 12 months after the date of purchase; we will notify you by email 30 days before any top-up pack expires. When credits are deducted, oldest credits are consumed first (FIFO).
4.3 Auto top-up. Pro and higher plans may opt in to auto top-up: when your balance drops below the configured threshold, we automatically charge the card on file for the selected pack and add the credits to your balance. Auto top-up is off by default. You may set an optional monthly spending cap on auto top-up. With auto top-up disabled, hitting zero credits triggers a hard stop until you manually top up or your next monthly reset.
4.4 Hard stop. When your balance reaches zero (and auto top-up is disabled or has hit its monthly cap), new requests are refused with a clear error. Streams already in flight complete normally; you are not billed beyond available credits.
4.5 Billing mechanics. Pro / Team / Business subscriptions are billed monthly via Stripe. Top-up packs are one-time purchases. Enterprise plans are invoiced via contract. Prices are listed in your selected currency (EUR, USD, or SEK) and are inclusive of Swedish VAT for consumers resident in Sweden; EU B2B customers may supply a valid VAT ID at checkout for reverse-charge treatment.
4.6 Service Level Agreement. The 99.5% (Team / Business) and 99.9% (Enterprise) availability targets above are formalized in a separate Service Level Agreement, available on request and signed at contracting. The SLA is a separate agreement and is not part of these Terms.
Your prompts are sent to third-party AI providers via Brain Orchestra, our LLM gateway (also operated by Xalerate AB). We store your chat history, eval runs, and saved datasets — including prompts and AI responses — on our servers so you can access previous work and so we can bill you accurately. You can delete individual chats, individual eval runs, individual datasets, or your entire account at any time from Settings. See our Privacy Policy for details on retention, legal basis, third-party processors, and international transfers.
You retain ownership of the prompts you submit and, to the extent copyright protection applies to AI-generated output, the responses you receive. Xalerate AB does not claim any rights to content you generate. You are responsible for ensuring that your use of AI outputs complies with applicable copyright, trademark, and publicity laws in your jurisdiction.
Just Smarter is provided "as is" and AI responses may contain errors, omissions, or hallucinations. We are not liable for decisions made based on AI-generated content. Except for liability that cannot be excluded under mandatory law, our total liability to you under or in connection with these terms is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the liability.
Nothing in this section limits any liability that cannot be excluded or limited under mandatory law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Swedish consumers retain the protections of the Konsumentköplagen and related mandatory consumer-protection rules.
You may delete your account at any time from Settings. We may suspend or terminate accounts that violate these terms, abuse the service, or engage in fraudulent activity. On termination, your data is deleted per our Privacy Policy, subject to statutory accounting retention for invoices and similar records.
We may update these terms from time to time. When we do, we will publish the updated version with a new version number and effective date, and for material changes we will ask you to re-confirm acceptance before continuing to use the service. Previous versions are retained in our consent audit log.
These terms are governed by Swedish law. Any disputes arising out of or in connection with them are to be resolved in the courts of Sweden.
If you are a consumer resident in another EU member state, nothing in these terms deprives you of the protection afforded by the mandatory consumer-protection rules of your country of residence, and you retain the right to bring proceedings in the courts of your home country under Regulation (EU) No 1215/2012 (Brussels I bis).
You may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr for consumer disputes.
If you are a consumer resident in the EU, you have a right of withdrawal under Distansavtalslagen (2005:59) and the EU Consumer Rights Directive (2011/83/EU) for fourteen (14) days from the date you subscribe to Pro or purchase a top-up pack. To exercise the right, email support@justsmarter.ai with your account email before the fourteen-day window expires, and we will refund the unused portion of your most recent payment.
Waiver for immediate use. When you use credits to run queries before the fourteen-day window expires, you explicitly consent to us beginning performance of the digital service and acknowledge that you lose the right of withdrawal for credits that have already been consumed. Unused credits remain refundable within the fourteen-day window.
Just Smarter is an AI system that generates responses using Large Language Models from third-party providers (Anthropic, OpenAI, Google, Mistral AI). When you use Just Smarter, you are interacting with software, not a human. Responses are generated automatically and may contain errors, omissions, or hallucinations — you should independently verify any factual claims before relying on them for important decisions.
Under the EU AI Act (Regulation (EU) 2024/1689), Just Smarter is a limited-risk AI system for the purposes of Article 50 transparency obligations. AI-generated content is not used to make automated decisions that produce legal or significant effects concerning you (GDPR Art. 22).
